Fluoride Toxicity Trial Update

The landmark federal trial pitting Fluoride Action Network (FAN) and others against the US EPA over water fluoridation came to a dramatic turning point Wednesday.  FAN has argued that fluoride’s ability to impact the mental development of both the fetal and infant brain posed an unacceptable risk to millions of Americans (and others) drinking fluoridated public water supplies. The dramatic moment came when, after both sides had completed their summary statements, the federal judge surprised everyone by recognizing the key plank in the plaintiffs’ case and undermining the key argument in the EPA’s case. The judge said: “So much has changed since the petition was filed…two significant series of studies – respective cohort studies – which everybody agrees is the best methodology. Everybody agrees that these were rigorous studies and everybody agrees that these studies would be part of the best available scientific evidence. The EPA appears to have applied a standard of causation, which from my read of TSCA is not accurate. It’s not a proper allocation. It’s not the proper standard.” In short, after 20 years of work by FAN and its supporters, and 70+ years of campaigning by opponents of fluoridation since its inception, Wednesday felt like a moment in time where the validity of our objections was finally recognized on a world stage.

Fluoride Trial Week 1: Scientist Says He Was Threatened Because of Fluoride Study

The first week of the historic water fluoridation trial wrapped up on Friday afternoon after four days of occasionally tense testimony from expert witnesses with the Fluoride Action Network (FAN) and the U.S Environmental Protection Agency (EPA). One expert witness claimed he had been coerced into signing a statement downplaying his study which claimed fluoride is a neurotoxicant. Another witness confirmed that at least one type of fluoride is a pesticide being added to the water supply. Attorneys with FAN argue that water fluoridation violates the 1970 Toxic Substances Control Act provisions which prohibit the “particular use” of a chemical which has been found to present an unreasonable risk to the general public. Under section 21 of the TSCA citizens are allowed to petition the EPA to regulate or ban individual chemicals. The EPA is represented by lawyers from the Department of Justice who are presenting experts from the corporate firm Exponent Inc. The government is defending water fluoridation and seeking a dismissal of the petition by the plaintiffs. The plaintiffs in the case include: FAN, Moms Against Fluoridation, Food & Water Watch, the American Academy of Environmental Medicine, the International Academy of Oral Medicine and Toxicology and the Organic Consumers Association. The corporate "mainstream" media is not covering the case at all.

Federal Lawsuit Could Limit Fluoride in Drinking Water

A landmark federal lawsuit that went to trial this week in California could change the longstanding practice of adding fluoride to the drinking water supplies for 200 million Americans. The lawsuit, brought against the Environmental Protection Agency by groups including the Fluoride Action Network, Food and Water Watch and Moms Against Fluoridation, would compel the agency to require local water utilities to stop adding fluoride to tap water. The suit claims fluoridated drinking water presents an unreasonable risk to public health and can harm the developing brain of young children and babies, causing an IQ deficit.

Studies: Fluoridated Water Linked to Low IQ and Kidney Dysfunction in Children

The validity of the 1950's American Public Health Policy, which embraced the dumping of the toxic byproduct Fluorosilicic acid into water reservoirs across the country in an attempt at “better living through chemistry," is being increasingly brought under scrutiny as more and more research suggests that drinking water ‘fortified’ with fluoride may be doing more harm than good. Recent studies suggest that the consumption of fluoridated drinking water is damaging to the developing brain of infants in utero, as well as making the connection between kidney and liver damage in adolescents and chronic low-level exposure to fluoride in their water.  Worrying is the fact that both studies were done using widely-accepted optimal levels of fluoride which are currently set at 0.7 milligrams per liter of drinking water.

Two Major Legal Victories in Federal Court Case to End Water Fluoridation

In November 2016, the Fluoride Action Network (FAN) together with a coalition of organizations and private citizens, including Food & Water Watch, American Academy of Environmental Medicine, International Academy of Oral Medicine & Toxicology, and Moms Against Fluoridation, presented a petition1 to the U.S. Environmental Protection Agency (EPA) calling on the agency to exercise its authority to prohibit the addition of fluoridation chemicals to the public’s drinking water supplies under Section 21 of the Toxic Substances Control Act (TSCA). FAN’s petition was made on the grounds that a large body of animal, cellular and human research shows that fluoride is neurotoxic at doses within the range now seen in fluoridated communities, and included over 2,500 pages of scientific documentation detailing these health risks. The Toxic Substances Control Act (TSCA) allows individuals to petition the EPA to regulate and prohibit the “particular use“ of a chemical if the petitioner can show that it presents an unreasonable risk to the general public or susceptible subpopulations. TSCA specifically gives the EPA the authority to prohibit drinking water additives. However, in an attempt to put up an unreasonable roadblock the EPA dismissed our petition based on a questionable interpretation of Congress’s recent amendments to TSCA. In response, FAN and our coalition partners filed a lawsuit in the U.S. District Court for the Northern District of California legally challenging the EPA’s denial of our petition. It also prompted the Natural Resources Defense Council to file an amicus brief challenging EPA’s strained interpretation of the law. Since challenging the EPA in court, a lot has happened to move us closer to a successful outcome. We have won our first two battles in federal court, new government-funded research has been published which strengthens our case, and our day in court has been scheduled.

Federal Lawsuit Against Forced Water Fluoridation Proceeds

In 2015, the federal government finally admitted that Americans were overdosed on fluoride, mainly due to municipalities adding fluoride to tap water. Fluoride has been implicated in neurological diseases such as Autism and Alzheimer’s Disease. Over the past few years, several municipalities have voted to stop automatic fluoridation of municipal drinking water, as it basically amounts to forced drugging of an entire population against their will. Large cities like Portland and Dallas were among the first to take measures to stop the practice. Today in 2018, the Fluoride Action Network (FAN) has a federal lawsuit in place against the Environmental Protection Agency (EPA) demanding a ban on forced water fluoridation nationwide. The EPA has tried to get this lawsuit dismissed, but so far has failed.

How the Mineral Boron found in Common Borax Helps Arthritis and Other Health Problems

Dr. Newnham was originally a professor of soil science and agricultural botany. After enduring the side effects of pharmaceutical drugs without improvement of his arthritic condition for years, he realized he needed to understand nutrition better to heal himself. Borax is a mined natural mineral compound that is high in boron. It is not a synthetic compound.

Unprecedented Lawsuit Could End Water Fluoridation in US Based on Neurotoxicity Studies

The Fluoride Action Network (FAN), along with a coalition of environmental and public health groups has filed a complaint in the U.S. District Court for the Northern District of California against the U.S. Environmental Protection Agency (EPA) in response to their denial of our petition under Section 21 of the Toxic Substances Control Act (TSCA) seeking a ban on water fluoridation. We believe this lawsuit is an unprecedented opportunity to end the practice once and for all in the U.S., and potentially throughout the world, based on the well-documented neurotoxicity of fluoride. According to FAN’s attorney and adviser, Michael Connett: “This case will present the first time a court will consider the neurotoxicity of fluoride and the question of whether fluoridation presents an unreasonable risk under the Toxic Substances Control Act (TSCA). And, in contrast to most other legal challenges of Agency actions, TSCA gives us the right to get the federal court to consider our evidence ‘de novo’ — meaning federal courts are to conduct their own independent review of the evidence without deference to the EPA's judgment.”

Polluted drinking water has been making headlines lately. The lead poisoning due to known but ignored faulty filtration from the water works in Flint, Michigan. No Evidence for Fluoridated Water to Result in Less Cavities

Two-thirds of Americans drink tap water that has added fluoride. Unlike other chemicals added to water, which are intended to treat the water itself, fluoride is intended to treat the people who drink the water, whether they want the treatment or not. As the Fluoride Action Network (FAN) puts it, “Fluoridating water supplies can thus fairly be described as a form of mass medication, which is why most European countries have rejected the practice.” In the U.S., many people assume the fluoride in drinking water is beneficial for their teeth, an assumption that has been widely spread by public health agencies. The U.S. Centers for Disease Control and Prevention (CDC) has partnered with the American Dental Association (ADA) in saying fluoridation is “nature’s way to prevent tooth decay” — a statement that is both misleading and inaccurate.
