Florida Man That has Served more than 20 Years in Prison for Shaken Baby Syndrome Appeals for New Trial
More than two decades into a 70-year sentence, Jim Duncan maintains his innocence. The central Florida man is serving time for aggravated child abuse. He was convicted of the crime after he and his wife brought their infant son Kody to the emergency room when they noticed he was in pain and not using the left side of his body. The doctor found 13 broken bones and a skull fracture in his X-rays, but no bruises. He called the police. "I am innocent," Duncan told CNN's Jean Casarez. "I did not harm my son." Duncan is hoping a new lawyer, and new medical science, will end his nightmare and bring him home. His lawyer is taking his case to the 2nd District Court of Appeals in Florida next week, and he is hoping for a new trial. Illinois radiologist Dr. David Ayoub said he believes Kody had infantile rickets, a disease of early life in which bones do not mineralize properly. Ayoub said he believes this led Koby to develop metabolic bone disease, causing Kody's bones to be very fragile. With that diagnosis, Florida Defense Attorney Lisabeth Fryer is working to get Duncan's conviction overturned.
University of Michigan Law School Awarded $250K to Learn How to Defend Shaken Baby Syndrome Cases
The University of Michigan's Innocence Clinic, part of the University's law school, has just been awarded $250,000 to fight wrongful shaken baby syndrome convictions. The Associated Press is reporting that the grant came from the Department of Justice. NPR Radio in Michigan reports that attorneys with the Innocence Clinic already helped exonerate one person in a shaken baby syndrome case. In 2010, Julie Baumer was retried and found not guilty of abusing her infant nephew. In 2015, the Michigan Supreme Court unanimously overturned a murder conviction in a shaken baby syndrome case. The court found that Leo Ackley's defense attorney did not properly challenge the conviction with evidence that contradicts the science of shaken baby syndrome, and that the prosecutor produced no witness that Ackley was abusive. The Assistant Director of the Michigan Innocence Clinic, Imran Syed, stated: "So these shaken baby syndrome cases really appear to be in that category of shifting science, where juries at trial were told things that seemed uncontroversial. But really there’s a lot of controversy involved. And really the most important thing, at least from our perspective as lawyers, isn’t who’s right or wrong. It’s did both sides get aired out in trial? Because our [state] supreme court ruled last year that in an SBS case, both sides have the right to present their side of the debate, and let the jury decide who they believe is more credible: was it an accident, or was it intentional abuse? And in the vast majority of these cases that we look at, there are no defense experts. The jury only hears one side of the case."

After all, we expect and want to believe that the recommendations being made by the “medical experts” are evidence-based and thoroughly tested for safety. In the case of the childhood vaccine schedule recommended by the U.S. Centers for Disease Control and Prevention (CDC) and American Academy of Pediatrics (AAP), the general assumption is that the safety of giving infants and children 49 doses of 14 vaccines between day of birth and age six has been thoroughly researched and proven safe. Many parents (and perhaps many pediatricians) would be surprised to learn there are a number of important unanswered questions about the number of vaccines, timing, the order and the ages at which recommended vaccines are given to babies and young children.

Then suddenly a large group of armed officers rushed in the door saying they were taking the children for seventy-two hours. We were to get the children two days of clothing and to do it fast. We were overwhelmed to say the least. The children were crying, Michelle and me were crying. Our hearts were broken. Our whole lives were invested in those children. How could anyone think they were in danger in our wonderful home? How could this be happening. A few minutes later my wife and I had sat in the living room, all alone and wondering what had happened. Twenty one months later it is over legally. What did they find? Nothing. All that pain for nothing? We are innocent! WE ARE INNOCENT! ARE THEY????
Flawed HPV Vaccine Safety Statement Revealed in Leaked E-Mails

In an open letter to the head of the World Health Organization, Dr. Sing Hang Lee, MD, the director of the Milford Molecular Diagnostics Laboratory in Milford, Connecticut, claims members of the WHO’s Global Advisory Committee on Vaccine Safety (GACVS) deliberately manipulated scientific data relating to the safety of HPV vaccines Gardasil® and Cervarix®. The letter states that the emails, obtained via a Freedom of Information request, clearly demonstrate members of the GAVCS, the CDC and the Japanese Ministry of Health, Labor and Welfare knew before the February 26, 2014 Tokyo public hearing that one of their own experts showed scientific evidence that HPV vaccination does increase cytokines, including tumor necrosis factor (TNF), particularly at the injection site compared to other vaccines.

Why did citizens of China have to petition their government for access to clinical trial data currently available via multiple national and international government sponsored internet sites? Why is information regarding HPV vaccines which is open for public view throughout most of the world deemed a ‘trade secret’ in China? Is that one of the reasons HPV vaccine clinical trial data is a ‘trade secret’ in China?

Having a "true finding" is devastating. Finding out that you have no constitutional rights, that the system is "protecting you and your children" with secrecy is maddening. This cannot happen in America, people think. It cannot happen to me. I am a good parent. Dealing with a system (even if not individuals) jaded by the horrors of the guilty, you are one more guilty perp maintaining your innocence. And the only thing the system hates worse than a child abuser is a child abuser who won't admit it. No horror movie ever prepared you for this. It obliterates the mirage of what you thought being an American meant. It changes you and scars you forever.
Does the Vaccine Court Violate America’s 7th Amendment?
With the upcoming 30th anniversary of the signing into law by President Ronald Reagan (Nov 14, 1986) of the National Childhood Vaccine Injury Act (NCVIA), I want to start the conversation about several areas of injustice of this Act. The signing of the NCVIA in 1986 established the National Vaccine Injury Compensation Program (NVICP) or commonly known as the Vaccine Court. The law also established VAERS, requires the CDC to develop and distribute vaccine information statements (VIS) for each vaccine administered, established a committee within the Institute of Medicine to review the literature on vaccine reactions, and created the Vaccine Injury Trust Fund to provide compensation for injuries or death from childhood vaccines. When faced with the seriousness of a vaccine injury, one seeks the comforting voice of an experienced attorney from the vaccine bar. Most of us do not know that several attorneys associated with the vaccine bar have gone to great personal financial hardship and sacrificing their own family life. Our government is closing the door on those who have been injured seeking compensation from the Vaccine Court, and one subtle way is making it more difficult to be represented by legal counsel.

If my Country ever truly existed she has just as surely as I lie here writing this with tears in my eyes been put to death by apathy, and greed, and weakness, and cowardice. Everyday I see injustice. Everyday I see oppression. Everyday I see on the faces of my clients; terror and anguish as they are forced to endure the wrath of "Child Protective Services". Child Protective Services operates with no sense of duty to the people. The checks and balances and safeguards created by our Constitutions are ignored today and no citizen in this State can be secure in his person, house, paper, or effect, if he is a parent with a minor child in his care. Arkansas DCFS boldly and openly operates outside both the US and Arkansas Constitutions and will continue to do so as long as we the people allow it.
12 Year Old Brianna’s Life Completely Changed by HPV Vaccine
My daughter, Brianna, was an active dancer since the age of 2 and a member of the school athletic team. She has always been fit and healthy and very academic. On September 28th 2011 at age 12 she had her first dose of the Cervarix (HPV) vaccine. Shortly thereafter everything changed. During the next 3 weeks she became increasingly unwell, experiencing fatigue, insomnia, constant nausea, increased body temperature, hot flushes, headaches and muscle and joint pain. She would attempt to go to school, but they would just send her home. Her GP carried out several blood and urine tests, but all results were negative. We asked the GP could it be a reaction to the vaccine. Our GP contacted the manufacturers who confirmed that her symptoms were recognised reactions, but not generally after this length of time. However, our GP advised that she should not have the 2nd and 3rd doses of the vaccine in case. Over the next 6 months Brianna could not handle more than 1 or 2 hours a week at school, some weeks there was no attendance. She also had to give up all sports and dancing.
Texas CPS Defies Judge’s Order to Homeschool, Keeps Rembis Children in Public School
On Monday September 26th, we reported that Texas Judge Hart made a stunning Pro-Family order at the close of the Adversary hearing for the Rembis family on September 20th, allowing Claire Rembis to homeschool her 10 children, even while they are in temporary state custody in Lubbock, Texas. On Monday September 26th, the Rembis’ met with CPS, who informed them they must start attending “Life Skills” classes beginning Saturday October 1st, and then allegedly made this shocking statement: “It’s not possible to homeschool while in foster care.” Therefore, the children remain in public school, directly defying Judge Hart’s order from September 20th. Some of the children are being bullied in public school, and CPS is forcing the children to get medical procedures against their parents' desires. Claire cried: "This is terrible. Just so mean. CPS will not abide by the court orders. We learned yesterday that they are not going to allow us to continue homeschooling. They have pretty much laughed in judge Harts' face."
Acetaminophen (Tylenol) Harmful for Babies
A 2016 article in the New York Times warns that prenatal use of acetaminophen—the main ingredient in Tylenol—has been linked to an increased risk of asthma and attention disorders in children whose mothers took the drug. Acetaminophen is found in over 600 over-the-counter and prescription medications. Petra Arck, professor of fetal-maternal medicine at the University Medical Center Hamburg-Eppendorf, whose rodent experiments have found that acetaminophen stresses the liver and alters the placenta in pregnant mice, told the Times that because it’s so common pregnant women may be taking more acetaminophen than they are aware. The damage done by acetaminophen seems to be dose dependent—the more a pregnant woman takes, the more serious the effects in her offspring. But since it’s found in so many products, many marketed for babies and children, what if infants, too, are being exposed to damagingly high levels of acetaminophen?
If Only Half of America is Properly Vaccinated, Where are the Epidemics?
In 2014, an outbreak of whooping cough (pertussis) broke out in the San Diego area. Of the 621 individuals who were infected, nearly all of them were completely up to date on all preventive vaccinations. If vaccines are given to protect from disease, how could this happen? San Diego public health official Dr. Wilma Wooten argued that the cause was related to a decrease in the protection offered by vaccines after the first year. This answer is most revealing, in that it speaks to the actual efficacy of vaccines. It also shows that the concept of herd immunity is largely myth—and completely misunderstood. The theory of herd immunity states that when a critical mass of the population (usually stipulated at 95%) is vaccinated against a disease, the possibility of outbreaks is eliminated. This is the main argument that is used to shame parents who wish to refuse certain vaccinations for their children: by not vaccinating, they put the health of the “herd” at risk. However, if vaccines start losing effectiveness after the first year, as Dr. Wooten says, then constant revaccination would be required, since the immunity offered is only temporary for most vaccines. Achieving the required rate of protection is virtually impossible under this paradigm. Of course, if we look back over the decades and note the lack of rampant epidemics in our nation, while remembering that vaccine protection is in perpetual decline, the myth of herd immunity quickly unravels. Our society has never achieved this level of herd immunity, yet not a single major outbreak of disease has occurred.
