With chronic disease rates soaring, HHS Secretary Robert F. Kennedy Jr. promised to address the root causes of our failing health and increase transparency in federal health agencies under the MAHA agenda.

Allowing Americans access to credible, science-based information about how food and nutrients support health would have been an obvious step in that direction.

The FDA has censored natural cures for diseases for many decades now, and if one sells a non-patented natural product that fights disease, they break FDA laws by making these claims in their advertising, with the threat of arrest and the seizure of their inventory.

The FDA only allows disease claims for patented pharmaceutical drugs, and if you make a disease claim for a natural product, even something as simple as “drinking more prune juice can cure constipation,” you can be arrested by the FDA using federal marshals for “practicing medicine without a license“.

I went through this myself back in 2005, when the FDA ordered me to remove all customer testimonials and links to peer-reviewed research regarding coconut oil, and threatened to seize my inventory until I complied.

MAHA promised to end this censorship on natural cures, but instead the FDA has doubled down on censorship and protecting drug industry profits.

Alliance for Natural Health (ANH) petitioned Kennedy’s FDA last year to allow nutrient disease claims that were backed up by the U.S. Government’s own scientists, and the FDA rejected their petition.

ANH is now suing the FDA, again.

MAHA Promised Transparency. FDA Delivered Censorship

The FDA, under RFK Jr.’s leadership, has rejected ANH’s petition to allow free speech about the relationship between nutrients and disease. It’s time to go on the offensive.

The FDA has formally rejected ANH-USA’s landmark petition seeking to open up Americans’ access to truthful, science-based information about the health benefits of nutrients. In response, ANH-USA will file suit against the FDA in federal court to challenge what we believe is unconstitutional censorship and a clear violation of federal law.

The importance of this case cannot be overstated. At a time when chronic disease rates are spiraling further and further out of control, and when we have a Health Secretary in RFK Jr. who rode into office on the wave of a grassroots Make America Health Again (MAHA) movement, our petition offered a golden opportunity: to empower Americans at the point of sale with information on how food and nutrients can help promote health and prevent disease—information sanctioned by the government’s own scientists.

Yet instead of transparency, the FDA appears to be doubling down to protect a drug-centric healthcare system.

FDA’s decision flies in the face of the First Amendment.

Under the landmark case Pearson v. Shalala, of which ANH-USA was a co-claimant, FDA may not suppress truthful, non-misleading health claims unless it can prove they are false. FDA did not even attempt to do that here.

ANH’s lawsuit will ask the court to enforce both FDAMA and the Constitution, restoring the public’s right to receive truthful health information at the point of sale.

FDA’s refusal to allow these claims does not protect consumers—it protects pharmaceutical profits.

As we argued previously, many of the censored nutrient–disease relationships overlap directly with conditions driving record-breaking drug sales:

• Diabetes: While drugs like Ozempic, Mounjaro, and Jardiance generate tens of billions annually, government-vetted research recognizes benefits from nutrients such as chromium, magnesium, zinc, and green coffee bean extract.
• Inflammation: Blockbuster biologics dominate the market, even though compounds like omega-3 fatty acids, selenium, boron, and Asian ginseng are recognized by government scientists for their anti-inflammatory effects.
• Heart health: The global cardiovascular drug market continues to explode, while nutrients such as magnesium, potassium, vitamins B1 and B12, vitamin D, and grape seed antioxidants remain sidelined.

By censoring nutrition science, FDA keeps consumers in the dark and preserves a pharmaceutical monopoly over healthcare choices. (Full article.)

Not only is Kennedy’s HHS giving more protection to the FDA and Big Pharma, the Trump administration is actually looking at giving big chemical companies, such as Monsanto/Bayer which produces the dangerous herbicide glyphosate which has been ruled to cause cancer, legal immunity against people suffering harm for their products, much like the pharmaceutical industry now enjoys.

MAHA vs Big Chemical: Who’s Winning in Washington?

The slogan Make America Healthy Again (MAHA) promised a future with less chronic disease, lower healthcare costs, and healthier communities.

But when it comes to environmental contaminants—pesticides, industrial chemicals, and so‑called “forever chemicals”—the Trump administration appears to be moving in the opposite direction.

Recent actions by the Environmental Protection Agency (EPA) and the Department of Justice reveal a pattern: weakening safeguards, siding with chemical manufacturers, and leaving Americans exposed to more dangerous toxins in their homes, food, water, and air.

Formaldehyde

Formaldehyde is a well‑known carcinogen found in furniture, building materials, clothing, and countless consumer products. A few years ago, the EPA prepared to regulate formaldehyde based on the assumption that there is no safe level of exposure: carcinogens don’t behave like ordinary chemicals, and even low‑level exposure can increase cancer risk.

That approach is now being scrapped. Under the administration of Lee Zeldin, the EPA has issued a draft memo assuming that a “safe threshold” for formaldehyde exposure exists, a move that would nearly double what the agency considers safe to inhale.

This is being driven by EPA leadership with deep ties to the chemical industry. The agency’s chemical safety office is now run by former senior officials from the American Chemistry Council (ACC)—the lobbying arm of major chemical manufacturers—who, during their time at ACC, pushed back against the EPA’s risk assessments of formaldehyde.

To be clear, what’s being proposed is: more formaldehyde in consumer products. More exposure in homes and schools. More respiratory illness. More cancer.

Glyphosate and Roundup

Meanwhile, the Trump administration is also going to bat for Bayer/Monsanto to protect them from liability lawsuits.

Glyphosate-based weed killers are implicated in thousands of lawsuits claiming exposures to them caused non‑Hodgkin lymphoma and other cancers. Juries across the country have repeatedly found that Monsanto—now owned by Bayer—failed to warn users of these risks. It’s why Bayer/Monsanto is backing legislation in Congress and at the state level to preempt these lawsuits.

Now, in a December filing with the Supreme Court, the Trump-appointed Solicitor General is urging the Court to take up the company’s appeal and rule that federal pesticide law preempts state “failure‑to‑warn” claims. Bayer’s argument is simple: because the EPA approved Roundup labels without a cancer warning, the company should be immune from lawsuits.

If the Court agrees, chemical companies could escape liability for the damage caused by their products.
