Dr. Peter McCullough is a world-renowned doctor and scientist in the scientific community and beyond who has spent his life building a positive reputation. Nevertheless, we have been informed that you have been maliciously spreading inaccurate and unfounded information that is damaging to his personal and professional character and reputation. Even more egregious, you are doing so at a time when the world is profoundly suffering at the hands of misinformation, yet significantly benefitting from the information Dr.  McCullough is providing regarding the COVID-19 vaccines.

You are hereby notified to cease and desist any and all further unlawful defamation, slander and/or libel with regard to your actions  and/or statements relating to the incident which occurred on December 13,2021 “Joe Rogan interview with Peter McCullough contains multiple false and unsubstantiated claims about the COVID-19 pandemic and vaccines” in which the following defamation occurred.

The defamatory statements include, but are not limited to, the following: “The Joe Rogan Experience, a podcast hosted by actor and comedian Joe Rogan, interviewed cardiologist Peter McCullough in December 2021. During the interview, which spanned about two  hours and 45 minutes, McCullough made multiple inaccurate, misleading and/or unsubstantiated claims about the COVID-19 pandemic and the COVID-19 vaccines. This isn’t the first time McCullough propagated health misinformation, as these earlier fact-checks by Health Feedback, Full Fact, and AFP show.”

In accordance with law, it is illegal to provide a false statement, whether written or oral, of an individual’s character and/or reputation, which:

1. Consists of any false statement intended to cause harm or damage another’s character and/or reputation;

2. Is communicated to another either in writing or verbally; and

3. The offending party is aware or should have been aware that such statement was false.

Dr. McCullough presented curated scientific slides displaying published data on SARS-CoV-2 and the pandemic response. There were no claims made. There was no false or misleading information given. Dr. McCullough on countless interviews has reviewed the Bradford-Hill criteria for causality and has demonstrated the vaccines have fulfilled these epidemiological criteria in terms of COVID-19 vaccination and death. Dr. McCullough cited and referenced on slides in the Joe Rogan Studio. More correctly, Dr. McCullough is an internist, cardiologist, epidemiologist managing the cardiovascular complications of both the viral infection and the injuries developing after the COVID-19 vaccine in Dallas TX, USA. Since the outset of the pandemic, Dr. McCullough has been a leader in the medical response to the COVID-19 disaster and has published “Pathophysiological Basis and Rationale for Early Outpatient Treatment of SARS-CoV-2 (COVID-19) Infection” the first synthesis of sequenced multidrug treatment of ambulatory patients infected with SARS-CoV-2 in the American Journal of Medicine and subsequently updated in Reviews in Cardiovascular Medicine. He has 54 peer-reviewed publications on the infection and has commented extensively on the medical response to the COVID-19 crisis in The Hill, America Out Loud, and on FOX NEWS Channel. On November 19, 2020, Dr. McCullough testified in the US Senate Committee on Homeland Security and Governmental Affairs and throughout 2021 in the Texas Senate Committee on Health and Human Services, Colorado General Assembly, New Hampshire Senate, and South Carolina Senate concerning many aspects of the pandemic response. On January 24, 2022, Dr. McCullough co-moderated and testified in the US Senate Panel “COVID-19: A Second Opinion” chaired by Senator Ron Johnson. Dr. McCullough has two years of dedicated academic and clinical efforts in combating the SARS-CoV-2 virus and in doing so, has reviewed thousands of reports, participated in scientific congresses, group discussions, press releases, and has been considered among the world’s experts on COVID-19.

As a journalist you could have and should have availed yourself of this/these fact(s) before making said false statements. Instead, you demonstrated reckless disregard for the truth. You made said defamatory statements in writing. Further, as a journalist you knew or should have known that your statement would be harmful to Dr. McCullough’s character and/or reputation. Accordingly, you bear the requisite intent for liability to Dr. McCullough for defamation by slander and/or libel. Additionally, we hereby contend that in accordance with slander and libel laws in this country, your defamatory remarks caused injury to Dr. McCullough’s reputation furthering your liability to him.

Therefore, you are hereby requested to immediately cease and desist the illegal defamation, slander and/or libel you have and are  engaging in with regard to Dr. McCullough [and within 10 business days, return the signed written assurance below affirming that you will refrain from any further acts of said defamation, slander and/or libel with regard to Dr. McCullough’s character and/or reputation].

Failure to comply with this cease-and-desist request, and/or return the signed assurance within the stipulated time, will leave us no other alternative but to pursue all available legal remedies, including but not limited to, filing a motion for injunctive relief, monetary damages, filing fees, court costs and/or attorney fees.

So here are the actual facts of what Health Impact News has published about Peter McCullough, and what Peter McCullough has said about Health Impact News, which is a matter of public record.

First, I have not published a single article about Joe Rogan, whether about Peter McCullough, or anyone else for that matter.

Secondly, everything we have published about Peter McCullough is a matter of public record, and easily verified.

We have published several articles about Peter McCullough, including highlighting the very fine work he has done in promoting early treatments for COVID-19, and exposing the COVID fraud. See:

But we have also published articles showing that Peter is very much pro-vaccine, as he supports the Novavax COVID-19 vaccine, and we very clearly cited our sources.

The Pro-Life Christian news site, Lifesite News, interviewed pro-vaccine Dr. Peter McCullough on August 5, 2021, who also spoke positively about the Novavax vaccine.

Speaking as a doctor, McCullough said that he has looked at studies of a vaccine called Novavax that does not use mRNA technology but is antigen-based, and he’s very encouraged by it.

According to the pro-life Charlotte Lozier Institute, Novavax is not produced using cell lines derived from the cells of aborted children. It appears, however, that some tests of this vaccine have involved the controversial cell lines.

“I [saw] rates of vaccine effectiveness over 2 to 5 months of 90%,” McCullough stated, but he cautioned that the studies were carried out before the Delta variant became dominant. Nevertheless, he is still hopeful that Novavax could offer a “broader amount“ of protection and with less risk of vaccine injury.

“It would be my understanding as a doctor, that this could be less likely to have these internal organ effects that we’re seeing with the other vaccines.” (Source.)

Dr. McCullough is opposed to the current COVID-19 shots, and has been a strong advocate for early treatments that he states are more effective than the COVID-19 shots which are harming people.

But even though he has had success with early treatments, he apparently still believes that COVID-19 is a real virus that is dangerous, and that a vaccine is still needed.

He was interviewed by the Right Wing America Out Loud podcast on September 2, 2021, which did a COVID Q&A with him.

One of the listeners, at about the 40-minute mark, asked him this question:

“Please, Dr. McCullough, give your analysis of the Novavax COVID vaccine.

I’ve been waiting for this vaccine to be available in the U.S. I’ve studied how it works, and how it differs from the RNA tech vaccines now being offered.

My conclusion is that this will be a safe vaccine. I am not anti-vaxx, and I do want to be vaccinated for COVID.

What is your analysis of the Novavax?”

This was Dr. McCullough’s response:

I agree with that conclusion. I’m not anti-vaxx either. In fact, I’ve had two vaccines this year.

I traveled to India a couple of years ago. I got extra vaccines. I have no problem with vaccines.

The Novavax is protein-based vaccine. It would be the purified spike protein that’s made, ah, in a, ah, medicinal format, 5 micrograms, they picked a lower dose.

In the published studies in the Journal of Medicine, it was every bit as good as Pfizer and Moderna.

And a sore arm, maybe the arm is sore a bit, more sore than Pfizer or Moderna or J&J, but should be free from the systemic side effects. Should be free, certainly free of any genetic, uhm, manipulation in the human body.

And I can completely agree. We need to get Novavax sooner. It was supposed to be second quarter of 2021, which is now.

The FDA has delayed it. And I think many ought to think about just waiting. If they can ride it out for Novavax.

You can listen to the full podcast here. The Delta variant was making the news rounds when this was recorded, and Dr. McCullough stated that the Delta variant was “more dangerous” than the original COVID-19 virus.

We have also reported that Peter McCullough has profited quite a bit from Big Pharma, even in 2020 when he was opposing COVID vaccines, by receiving payments from the pharmaceutical industry.

This is public information and we linked to the source, which is Open Payments.

Peter McCullough collected over $2 million in payments from Big Pharma from 2014 through 2020, mostly for “consulting fees,” but also including “Food and Beverage” and “Travel and Lodging” among other payments.

In 2020, when he was opposing the COVID-19 vaccines, he received kickbacks from two of the companies that produced COVID-19 vaccines, $41,649.05 from Astrazeneca, and $10,000 from Janssen Research.

Thirdly, Peter McCullough is actually the one who has committed “illegal defamation, slander and/or libel,” as he said in an interview with Red Voice Media published on February 6, 2022:

Let me just say that fact checkers, Health Impact News and the fact checkers – they’ve been fact checked themselves.

So, Dan O’Connor at TrialSiteNews fact checked the fact checkers. And he found them to a one to be 100% fallacious.

They don’t cite their claims. They’re making false claims. And then within a few clicks, every single one of them traces back to one of the vaccine stakeholders.

Healthfeedback, Health Impact News, they all trace back to… Dan O’Connor at TrialSiteNews has really exposed that.

In making this accusation against us in public, Peter McCullough has himself made a “false claim” and slandered Health Impact News in the process.

Should we pursue legal redress of these libelous false claims, we will add you, Parisa Fishback, as well as the “Strategic Advisory Council” of “The Unity Project,” that you claim to represent, as defendants in our complaint.

In the meantime, Health Impact News has broken no laws in our coverage of Peter McCullough, and we rigorously oppose your feeble attempts to censor us.
