Trump Issues EO to Produce More Glyphosate Herbicide in the U.S. After Bayer Settles Cancer Lawsuits for Hundreds of $Millions

Earlier this week, on February 17, 2026, agrochemical maker Bayer, who purchased fellow agrochemical maker Monsanto in 2018, and inherited the Roundup brand of herbicides containing glyphosate, which has been linked to cancer, announced a $7.25 billion settlement with cancer patients due to their use of glyphosate.

Agrochemical maker Bayer and attorneys for cancer patients announced a proposed $7.25 billion settlement Tuesday to resolve thousands of U.S. lawsuits alleging the company failed to warn people that its popular weedkiller Roundup could cause cancer.

The proposed settlement comes as the U.S. Supreme Court is preparing to hear arguments in April on Bayer’s assertion that the U.S. Environmental Protection Agency’s approval of Roundup without a cancer warning should invalidate claims filed in state courts. (Full article [1].)

The very next day, on February 18, 2026, President Trump issued an executive order mandating domestic production of elemental phosphorus and glyphosate-based herbicides, for use in agriculture and the military.

BOLSTERING NATIONAL SECURITY BY PRESERVING CRITICAL SUPPLY CHAINS: Today, President Donald J. Trump signed an Executive Order mobilizing the Defense Production Act to protect domestic production of elemental phosphorus and glyphosate-based herbicides — two critical inputs essential to military readiness and America’s agricultural strength, respectively.

  • The Order finds that any interruption of supply of either of these critical materials could leave our defense industrial base and food supply vulnerable to hostile foreign actors.
  • The Order delegates the President’s authority under the Defense Production Act to the Secretary of Agriculture to require the performance of contracts or orders related to these materials to promote the national defense, and to determine the proper allocation of materials, services, and facilities necessary to ensure a continued and adequate supply of these products. It directs the Secretary of Agriculture to exercise that authority in consultation with the Secretary of War.
  • The Order directs the Secretary of Agriculture to issue orders and regulations as needed for implementation.

COUNTERING THREATS TO AMERICA’S DEFENSE AND FOOD SECURITY: President Trump is acting to ensure domestic production of elemental phosphorus and glyphosate-based herbicides, the loss of which would cripple critical supply chains.

  • Elemental phosphorus is a key input in defense supply chains — crucial for smoke, illumination, and incendiary devices, semiconductors in radar, solar cells, sensors, and optoelectronics, and modern lithium-ion battery chemistries used in weapon system supply chains.
  • Elemental phosphorus is also a critical precursor element for the production of glyphosate-based herbicides, which are the most widely used crop-protection tools in U.S. agriculture — enabling efficient food and livestock feed production that protects food supply chains and ensures the availability of healthy, affordable food options within reach for American families.
  • With only one domestic producer of elemental phosphorus and glyphosate-based herbicides, and U.S. needs far exceeding current output, the threat of reduced or ceased production gravely endangers national security and defense, which includes food-supply security.
  • The Administration continues to support research and investment into next-generation crop protection technologies, but ensuring a stable supply of existing critical inputs remains essential to safeguarding food security and national defense.

This executive order gives further evidence that chemical companies like Bayer and Monsanto have a long history of using their herbicide chemicals in both the military and agriculture.

In the military, uses of their chemicals kill people, such as Monsanto’s “Agent Orange” which was used in the Vietnam war.

In the agricultural use of their chemicals, they kill weeds while protecting genetically modified crops that have been engineered to survive being sprayed with these killer chemicals, such as Roundup.

Monsanto’s History of Corruption in Hiding Glyphosate’s Harm to Human Health via “Trade Secrets”

Health Impact News has been one of the leading alternative news sites in the U.S. covering the dangers of glyphosate for almost a decade-and-a-half now, and a search for the term “glyphosate [3]” will yield a result of almost 400 articles during that time span on Health Impact News.

In the mid 2010’s, two MIT scientists, Dr. Anthony Samsel and Dr. Stephanie Seneff, along with Dr. Don M. Huber, Professor Emeritus of Plant Pathology at Purdue University, began to warn the public about secret documents held by the EPA over the dangers of glyphosate, and its pervasive negative impact on human health.

I assigned my top investigative health reporter at that time, the late John P. Thomas [4], to research this issue, and he conducted a series of interviews with Dr. Huber and Dr. Seneff in 2014 which I published in two different articles:

In March of 2015, the International Agency for Research on Cancer (IARC), which is part of the World Health Organization (WHO), released a report listing glyphosate as “probably carcinogenic” in causing non-Hodgkin lymphoma and prostate cancer.

This was headline news all around the world, even in the corporate media.

Right after this report, Dr. Anthony Samsel went public with what he claimed were “Trade Secret” sealed files that he had obtained from the EPA, which he claimed proved that Monsanto knew about research connecting glyphosate to cancer since the 1970s. See:

What followed for the next several years in the U.S. were lawsuits against Monsanto for harm caused by glyphosate, as well as many groups petitioning the EPA to list warnings on sales of glyphosate, where anybody, even children, could walk into any store selling garden supplies and purchase Roundup.

But the EPA did what it usually does, and stood up for Monsanto by refusing to not only phase out the use of glyphosate in agriculture, but refused to even place a warning on its sale in retail stores across the U.S. where it is still sold to this day.

Here is the current EPA position on Glyphosate [8] (emphasis mine):

Glyphosate

Glyphosate is a widely used herbicide that controls broadleaf weeds and grasses. It has been registered as a pesticide in the U.S. since 1974. Since glyphosate’s first registration, EPA has reviewed and reassessed its safety and uses, including undergoing registration review, a program that re-evaluates each registered pesticide on a 15-year cycle.

In February 2020, after receiving and considering public comments on the glyphosate proposed interim decision, EPA published the interim decision registration review decision (ID) for glyphosate. As part of this action, EPA found that there are no risks of concern to human health when glyphosate is used in accordance with its current label.

EPA also found that glyphosate is unlikely to be a human carcinogen. The ID also identified potential ecological risks to non-target organisms, primarily non-target plants through spray drift. The ID identified interim risk mitigation measures in the form of label changes, including spray drift management language, herbicide resistance management language, a non-target organism advisory, and certain label consistency measures.

It concluded that the benefits of glyphosate outweigh the potential ecological risks when glyphosate is used in accordance with labels. (Where have we heard that “logic” before??)

On March 20, 2020, the glyphosate ID was challenged in the U.S. Court of Appeals for the Ninth Circuit. Petitioners challenged EPA’s analysis of human health and ecological risk, the weighing of such risks against the benefits of glyphosate and the interim risk mitigation measures, and alleged that EPA violated the Endangered Species Act (ESA).

On May 18, 2021, EPA sought partial voluntary remand without vacatur of the ecological portion of the ID so the Agency could revisit aspects of its analysis in light of EPA’s November 2020 draft biological evaluation for glyphosate and recent court decisions for other herbicides, among other reasons.

On June 17, 2022, the U.S. Court of Appeals for the Ninth Circuit vacated the human health portion of the glyphosate ID and held that EPA’s registration review decision under FIFRA was an ‘action’ that triggered ESA obligations. The court also granted EPA’s request for voluntary remand, without vacatur, of the ecological portion of the ID but imposed an Oct. 1, 2022 deadline for EPA to issue a new ecological portion. EPA sought relief from this deadline, which the court denied on Aug. 5, 2022.

EPA determined that withdrawal of the glyphosate ID was appropriate in consideration of the Ninth Circuit’s June 17, 2022 decision. The Agency was unable to finalize a new ecological portion in a registration review decision for glyphosate by the court-imposed Oct. 1, 2022, deadline because of the time needed to address the issues for which EPA sought remand of the ecological portion and satisfy ESA requirements.

EPA initiated formal ESA consultation with the U.S. Fish and Wildlife Service and the National Marine Fisheries Service (the Services) for glyphosate in November 2021, and consultation is ongoing. Moreover, before issuing any decision, EPA must first prepare a proposed decision, publish for a 60-day public comment period, and consider any comments received. EPA could not complete these processes by the court-imposed deadline.

In accordance with the court’s decision related to human health, the Agency is currently updating its evaluation of the carcinogenic potential of glyphosate to better explain its findings and include the current relevant scientific information.

For the ecological portion, EPA intends to address the issues for which it sought remand, including: to consider whether additional or different risk mitigation may be necessary based on the outcome of ESA consultation for glyphosate, prepare an analysis of in-field effects of glyphosate on monarch butterfly habitat, consider whether there are other aspects of its analysis of ecological risks and costs to revisit, and consider what risk mitigation measures may be necessary to reduce potential risk following completion of analyses left outstanding in the ID.

EPA also intends to complete ESA consultation with the Services, communicate its determination under the Endocrine Disruptor Screening Program, and respond to an administrative petition regarding glyphosate before issuing a final registration review decision.

EPA is currently working to complete the analysis above as we continue registration review of glyphosate. Although the glyphosate ID has been withdrawn, that does not automatically mean that EPA’s current scientific findings regarding glyphosate, including its longstanding finding that glyphosate is not likely to be carcinogenic to humans, is incorrect or cannot be used as support for a future decision. So the EPA obviously knows there are problems with glyphosate, but they are “still studying the issue”, even though according to Dr. Samsel, they have had the scientific literature linking glyphosate to cancer since the 1970s and have been hiding it under patent law and “trade secrets” that belonged to Monsanto, and now belong to Bayer.

Now you can understand how significant the civil litigation has been against Monsanto and Bayer, and how their $7.25 billion settlement with cancer patients earlier this week was a huge threat to both Bayer and the EPA.

But their buddy in the White House, the Pedophile in Chief, Donald Trump, took care of them. So not only will the use of Bayer’s Roundup NOT be decreased in the U.S., it will now increase due to Trump’s EO.

Military Applications for Glyphosate?

Bayer/Monsanto may also be looking at military applications of glyphosate, as the U.S. prepares for war in the Middle East.

In 2018, after a California jury awarded millions of dollars in damages to a groundskeeper who got cancer from repeated exposure to Monsanto‘s Roundup, Vietnamese victims of Monsanto’s Agent Orange during the Vietnam war also tried to revive legal claims against Monsanto:

In fact, in 2014, the active ingredient in Agent Orange, the herbicide 2,4-D, was used by Dow Chemical for a “new” product to use on U.S. crops, and they petitioned the EPA to start using it on GMO corn and soybeans. The EPA granted them limited use [11], although its use is minuscule compared to Glyphosate.

Certified Organic Food Grown in U.S. Found Contaminated with Glyphosate Herbicide

Going back to 2014 when John Thomas began investigating all the problems glyphosate was causing for human health, I took note of what Dr. Don Huber, Professor Emeritus of Plant Pathology at Purdue University, stated about his claims that grains grown in the U.S. were also contaminated with glyphosate.

After all, there are NO wheat or other grains that are genetically modified currently in the U.S., although Monsanto has tried.

Therefore, wheat and other grains will be killed by glyphosate, just as the weeds are.

This is what Dr. Huber told John Thomas:

There are two reasons that a farmer wants to [use glyphosate on non-GMO crops]. It is for late season weed control in situations where he has patches of green weeds in the field that came up late. [This is commonly done with wheat and barley.] It is a little slower to harvest when weeds are present.

The other reason involves late season snow. In the northern region such as in the Dakotas, in certain parts of Montana, and in the Prairies of Canada, there is a very short growing season. If it snows on the crop at harvest then you may lose the crop, because you can’t get back into the field to do the harvest.

In these regions, 70% of the wheat and barley are desiccated with glyphosate before harvest. [This kills the plant so that it will wilt and dry]. Farmers don’t want to take a risk of losing their entire wheat and barley crop, so they will take a cut in yield and quality by using glyphosate a few weeks before harvest and then harvest the crop early.

Farmers don’t realize how much they are contaminating that food or feed product when they do this. They will accept the cut [in quality and quantity of the crop], because that can buy them a week advantage in harvest. It’s really more done for ease and planning. However, it is just the dumbest thing you could ever do from a health and safety standpoint.

In fact, beer brewers are having a problem with glyphosate. A few years ago, when one of my colleagues wanted to get more Abraxis test strips for testing materials for glyphosate residue, he was told that they had a 3-month backlog. He asked, what was causing this? He was told that every load of malt barley coming out of North Dakota has to be tested because the glyphosate levels were so high that it kills the yeast in the brew mix. (Source [13].)

I decided to fact-check Dr. Huber’s claims. We pulled several commercial bread products from the shelves of grocery stores in the U.S. where we could verify that they were produced from wheat grown in the areas where Huber was claiming they were spraying Roundup on: the Dakotas, Montana, and Canada.

Every single sample we tested were found to have varying amounts of glyphosate present, verifying Dr. Huber’s claims.

At the time, my online store was selling some organic grains and stone-ground flours from a small family mill in Wisconsin. I decided to test them as well, expecting them to test clean.

They didn’t. In fact, some of them had almost the same amounts of glyphosate present as non-organic grains.

I stopped selling them immediately, and published my research on Health Impact News, which shocked the Natural Food industry at that time.

When we tested USDA Certified Organic corn products from U.S. grocery store shelves, not only did we find them contaminated with glyphosate, they were also contaminated with GMO DNA, even though they were “certified organic.”

We learned that the the USDA NOP (National Organics Program) allowed for trace amounts of glyphosate based on the EPA allowances approved for non-organic crops.

We then started phasing out all of our USDA certified organic products and started testing ALL of our foods for glyphosate, and all of our corn for GMO DNA.

This started in 2014, and to my knowledge, we are still the only store in America that tests all of our food before selling it, something we have been doing for almost 12 years now.

Corn was the most difficult product to source, as to this day, every single certified organic corn grown in the U.S. that we have tested, has been contaminated with GMO DNA. We had to source our corn from provinces in Central and Southern Mexico, where GMO corn is banned.

When it came to glyphosate, the one product that was the most contaminated in the U.S. was honey. Most people do not realize that honey is mainly a by-product of the agricultural industry, as beekeepers make their money by pollinating crops, especially in California, where the #1 agricultural product is almonds. Honey is the World’s Healthiest Sweetener but the North American Honey Supply is Contaminated [19]

For years we carried a honey from the remote areas of British Columbia in Canada, where the bees only collected pollen from wild flowers in the summer, far away from commercial agriculture, and always tested clean of glyphosate.

But a few years back, even this honey started testing positive for glyphosate, possibly contaminated from rain water. It was the only source of honey that had ever tested clean of glyphosate in North America.

So now we have to import our honey from Chile [20], made from bees in the Andean mountains and rain forests, where samples continually test clean for glyphosate.

Glyphosate drift is a real problem, as a study back in 2014 found samples in our air and rain water. (Source [21].) I am sure it is getting worse every year now.

Grains are the other hard-to-find agricultural products in the U.S. that have not been contaminated with glyphosate. We initially imported all of our wheat and ancient grains from Italy, where they consistently test clean from glyphosate, because Italians, in general, place a very high value on their food sources, unlike American consumers.

In recent years we have found a few farmers growing grains in the U.S. outside of the northern states where they desiccate their crops in the fall before the first snow fall.

But due to some bad harvests last year, and even with some farms outside the northern states that do not desiccate their crops, we are finding grains that are testing positive for glyphosate.

We are currently out of stock on many of them, and preparing to put in another order from Italy, although still facing uncertain tariff duties even with the U.S. Supreme Court decision yesterday that nullified most of Trump’s current tariffs in place.

The one ancient grain we have plenty of supplies on right now is the ancient grain Khorasan. Khorasan has become more popular in the U.S. in recent years, but almost all of it is grown in Montana. We tested some, and found it contaminated.

But a couple of years ago we found one farm outside of Montana, the Dakotas, and Canada that was growing Khorasan, and it tested clean. We bought almost his entire harvest, and we still have good supplies of it, for now.
