Does the Vaccine Court Violate America’s 7th Amendment?

With the upcoming 30th anniversary of the signing into law by President Ronald Reagan (Nov 14, 1986) of the National Childhood Vaccine Injury Act (NCVIA), I want to start the conversation about several areas of injustice of this Act. The signing of the NCVIA in 1986 established the National Vaccine Injury Compensation Program (NVICP) or commonly known as the Vaccine Court. The law also established VAERS, requires the CDC to develop and distribute vaccine information statements (VIS) for each vaccine administered, established a committee within the Institute of Medicine to review the literature on vaccine reactions, and created the Vaccine Injury Trust Fund to provide compensation for injuries or death from childhood vaccines. When faced with the seriousness of a vaccine injury, one seeks the comforting voice of an experienced attorney from the vaccine bar. Most of us do not know that several attorneys associated with the vaccine bar have gone to great personal financial hardship and sacrificing their own family life. Our government is closing the door on those who have been injured seeking compensation from the Vaccine Court, and one subtle way is making it more difficult to be represented by legal counsel.

Vaccine Court Stats on Injuries and Deaths Betray Government’s Position on Vaccine Safety

Every day, people in the United States are being injured and killed by vaccines. This is a fact that is not in dispute, as the Department of Justice's quarterly report on vaccine injuries and deaths clearly demonstrates. And yet, the government's official public statement about vaccines is that they are safe and effective, and should be mandated for all people. Any opinion or presentation of facts to contradict their position is vigorously suppressed and censored all in the name of "public health" for the "greater good." The American public is largely unaware that there is a vaccine court known as the National Vaccine Injury Compensation Program (NVICP). This program was started as a result of a law passed in 1986 that gave pharmaceutical companies total legal immunity from being sued due to injuries and deaths resulting from vaccines. If you or a family member is injured or dies from vaccines, you must now sue the Federal Government in this special vaccine court. Many cases are litigated for years before a settlement is reached. Once every 3 months the Advisory Commission on Childhood Vaccines meets, and the Department of Justice issues a report of cases settled for vaccine injuries and deaths. As far as I know, Health Impact News is the only media source that publishes these reports each quarter. The most recent report is from March 3, 2016. Every quarter for the past couple of years, it has been increasingly difficult for Health Impact News to obtain this report, which used to be routinely published on the Health Resources and Services Administration (HSRA) government website. Health Impact News just now received the report from March, and in a couple of weeks the next report will be due at the June meeting. The report for March 3, 2016 which covered the period from 11/16/15 to 2/15/16 had 199 cases adjudicated. 108 of them were listed in the report, specifying the vaccine, the injury or death, and the amount of time the case was pending before settlement. There were three deaths: two related to the flu vaccine, and one related to the TDaP (Tetanus, Diphtheria, Pertussis) combo vaccine. 88 of the 108 cases settled were for injuries and deaths due to the flu vaccine, making the flu vaccine the most dangerous vaccine in the U.S., harming and killing more people than all the other vaccines put together. There were three deaths: two related to the flu vaccine, and one related to the Hepatitis B vaccine, which is a vaccine for a sexually transmitted disease routinely given to newborns in hospitals the same day they are born. 64 of the 83 cases settled were for injuries and deaths due to the flu vaccine, making the flu vaccine the most dangerous vaccine in the U.S., harming and killing more people than all the other vaccines put together.

Vaccine Injuries and Deaths Continue to Increase in Federal Vaccine Court

The Department of Justice issues a report on vaccine injuries and deaths every quarter to the Advisory Commission on Childhood Vaccines (Click on "Meeting Book - PDF - 12 MB" for June 4 meeting). There were 163 cases for vaccine injuries and deaths for the period 2/16/2015 through 5/15/2015. 103 of the settlements were listed in this report, giving the name of the vaccines, the injury, and the amount of time the case was pending before settlement. Four of those settlements were for deaths linked to vaccines, with three deaths related to the flu shot, and one death for the Hepatitis B shot, typically given to newborns. 74 of the 103 settlements were for injuries and deaths due to the flu shot, and the majority of flu shot injuries were for Guillain-Barré Syndrome. These companies have been granted legal immunity, and one has to sue the federal government in a special "Vaccine Court" to try and get a piece of the Vaccine Injury Compensation Trust Fund, which is funded by taxpayer's taxes paid on the purchase of vaccines. Therefore, much of the information regarding Gardasil injury claims and lawsuits today come from countries outside the U.S., and information about Gardasil injuries inside the U.S. comes mainly from the alternative media which is not sponsored by the pharmaceutical industry. March 2015 Settlements in Vaccine Court: 117 Vaccine Injuries and Deaths

The Depart of Justice issues a report on vaccine injuries and deaths every quarter to the Advisory Commission on Childhood Vaccines. The March 5, 2015 report states that there were 117 cases for vaccine injuries and deaths compensated from 11/16/2014 to 2/15/2015. Five of those settlements were for deaths linked to vaccines, with three deaths related to the flu shot. The unified message presented by the U.S. mainstream media and certain government agencies is that vaccines are safe. This is a lie. Vaccines are dangerous. People are injured and killed by vaccines, and the quarterly reports from the DOJ, which probably reflects a very small percentage of the actual cases, clearly reflect that inherent danger.

Charlotte Observer Reports on Child Crippled by Vaccines and Awarded $2 Million in Damages

The Charlotte Observer has done something that is quite rare: they have reported the truth about a child who received the recommended childhood vaccines, and then became brain damaged. The family was awarded a $2 million settlement in vaccine court, which the Charlotte Observer also reported. Will this story remain on the Internet, or will it face the same fate as a recent Toronto Star investigative report about girls damaged by the Gardasil vaccine? GAO Report on Vaccine Court Reveals Vaccine Injured Victims Not Being Helped

In November 2014 the Government Accounting Office (GAO) issued the first report on America's "Vaccine Court," known as the National Vaccine Injury Compensation Program (NVICP), in almost 15 years. As we have previously reported here at Health Impact News, the Vaccine Injury Compensation Trust Fund, which is funded by taxes paid on vaccines, has now grown to about $3.5 BILLION. Previous GAO reports on the NVICP have criticized the rate at which this fund was growing and being kept by the federal government, instead of being paid out to victims who have been injured or killed by vaccines. The November 2014 GAO report on Vaccine Injury Compensations revealed some problems with the National Vaccine Injury Compensation Program that the mainstream media reported. These problems include the fact that most people are still unaware that this program even exists, that it can take many years to settle a claim for a vaccine injury or death, and that while this program was originally designed for injuries and deaths due to childhood vaccines, that most claims now are made by adults injured or killed by the annual flu shot. But there are many more problems associated with the National Vaccine Injury Compensation Program that the mainstream media is not covering, so I have invited Wayne Rohde, author of a recently published book on this topic, The Vaccine Court: The Dark Truth of America's Vaccine Injury Compensation Program, to give a more in depth report that you are unlikely to read in the mainstream media.
