A judge in federal court in New York ruled today that the Trump Administration, who arrested Mahmoud Khalil over this past weekend with no warrant, and who was being detained in Louisiana with no contact allowed between him and his attorneys and his wife who is 8 months pregnant and is a U.S. Citizen, had to allow Khalil access to his attorneys so he could appear in court.
Prominent Palestinian activist Mahmoud Khalil will remain in an ICE detention facility in Louisiana for now following a procedural hearing in New York, days after he was arrested by federal officials at his Columbia University residence in an attempt by the Trump administration to deport him.
Khalil was arrested and detained on Saturday over his role in protests against the Israel-Hamas war at Columbia University last spring. His green card was revoked by the Trump administration, his lawyer said, but New York federal judge Jesse Furman blocked any immediate effort to deport Khalil until his attorneys and the federal government appear in court.
In court Wednesday, Furman ordered that Khalil be allowed at least one call Wednesday and one Thursday with his counsel as they prepare to meet briefing deadlines, after his attorneys asked the court to help them gain better access to their client.
“We literally have not been able to confer with our client once since he was taken off the streets of New York City,” Ramzi Kassem, an attorney for Khalil, said. (Source [1].)
Meanwhile, protests have erupted in New York over Khalil’s arrest, and many Jews are also among the protesters. At least a “dozen” protesters were allegedly handcuffed by police earlier today, but it is not clear yet at the time of this writing if they were actually charged or detained.
Some news reports are claiming that the reason why Khalil was taken from New York to be detained in Louisiana is because he was not charged with any crime, and therefore they did not have to comply with Khalil’s attorney who filed a habeas corpus [2], because it lacked jurisdiction.
Did the Trump Administration Make a Huge Mistake by not Knowing Mahmoud Khalil was a Legal Resident of the U.S.?
While many media sources have now stated the same thing that I published when this story broke [3], which is that this is a “test case” for the Trump Administration on deporting students who protest against the Israeli government, it would appear that Trump’s Zionist officials did not even know that this man was no longer a student, and was not even in the U.S. on a student visa anymore.
And they also seem to be completely ignorant of the differences between visas and Green Cards, which represent permanent residents in the U.S. who no longer need visas.
Fox News, just a short while ago as I began to write this article and should know better by now with everything that has come out in the news the past few days, deliberately LIED to the American people by bringing in “legal experts” on to their show who stated incorrectly that Khalil’s “visa as a foreign student” had been revoked, and that the “law is on Trump’s side.”
Well, how can a “legal expert” claim that the law is on the side of Trump if they misrepresent the facts of the case?
As was originally reported by Khalil’s attorney in her report to the media after Khalil was arrested, she informed the ICE officials that Khalil was a holder of a Green Card, not a student visa. They then allegedly told her that they were revoking that too, and hung up on her.
But there is huge difference between a student visa and a Green Card issued to permanent residents.
Green Cards are difficult to obtain (I went through the entire process after I married a Filipino woman from the Philippines in my first marriage), and Khalil was reportedly able to obtain one last year due to his marriage to a U.S. Citizen, who was also threatened with arrest last weekend.
To be issued a Green Card, you have to file a petition with the U.S. Citizenship and Immigration Services, who then does a background check and investigates the applicant, before issuing them permanent residency.
So Khalil was already approved, last year, by Immigration Services to be a U.S. permanent resident. He is married to a U.S. citizen, and is no longer a student here on a student visa. His activities in the student protests at Columbia University would have already been known when he applied for his Green Card last year, and was approved!
By law, only an immigration judge in immigration court can revoke a Green Card. The Trump Administration seems to have learned this over the past couple of days, because they are now backtracking on stating that they are going to immediately deport Khalil, because as a permanent resident, he will get his day in immigration court.
The Trump Administration, in spite of the “legal expert” opinions, are going to have to actually provide proof of his criminal activities to get a judge to agree with them that he should have his permanent residency revoked and be deported. (Source [4].)
So Fox News and many other Right Wing news publications are LYING about this. We do not have a true test case about removing a foreign student’s visa yet, as the Trump Administration hasn’t even tried that yet, but instead arrested a U.S. permanent resident first, with no warrant.
I don’t think this will go well for them, even if they appeal it all the way to the Supreme Court.
Many Conservative Christians and Libertarians No Longer Care About the First Amendment as They Attack Khalil as “Liberal” or as a “Hamas Terrorist”

ZeroHedge News, once considered a “libertarian” publication, is now full blown pro-MAGA and pro-Trump, perpetuating the “democrats and liberals are evil” mantra that prejudices people based on the political groups they belong to. Source [5].
Sadly, most conservatives and even most libertarians are condemning Khalil, not based on the facts of the case and what immigration law actually states in regards to the rights of permanent residents, but based on him being a “liberal” who probably received funding for his work in protesting from “communist” sources, such as George Soros.
I included a screenshot from a recent article on ZeroHedge News [5], where the headline suggested that because those supporting Khalil are “democrats”, that somehow made the issue of “free speech” insignificant in this case because democrats don’t know what “free speech” really is, allegedly because they don’t support conservative issues like they do.
Others just follow the Trump Administration’s propaganda in branding Khalil, along with other student protesters, including many Jews, as “terrorists” who support Hamas.
So I went to a couple of different Internet Search sites, and decided to do an image search on the phrase “pro hamas student protest”, since the right wing conservative media keeps portraying the student protests as “pro hamas”.
I could not find a single photo from student protests where anybody was holding any kind of sign that had the word “hamas” on it. I provided a screenshot from duckduckgo.com above.
Where is the evidence that these students are “pro-Hamas terrorists”? And if most of them are “liberal democrats”, including all the Jewish students at these protests, how does that affect the First Amendment?
Do not “liberal democrats” also have a right to free speech? How can “liberal Jews” who protest against the massacre and genocide of Palestinians be “Hamas supporters” just because they are “liberal”??
One thing we do know, however, is that the U.S. and Israel support Hamas, both through funding them, and negotiating directly with them.
So it is actually the pro-Israel Republican Conservatives who are supporting Hamas, according to the Israeli media.
