As we reported earlier this month, Maui’s voter-approved ban on GMOs in their county has met with opposition from the well-funded biotech industry. (See: Victory! Hawaii Leads Nation on Banning GMO Crops.)

Monsanto and others have challenged the voter resolution in court, and the county has agreed to delay the ban until all legal challenges are resolved.

Federal judge blocks Maui GMO moratorium

The fight continues against GMOs on Maui.

U.S. Magistrate Judge Barry Kurren has blocked the county from implementing the new law. Both sides agreed to delay the date. This comes a day after Monsanto and other individuals, groups and businesses filed a lawsuit to challenge the ban.

The case put the county in the awkward position of asking a judge to order it to not enforce one of its laws. But Maui County spokesman Rod Antone said it’s hard to enforce the law when it’s being challenged. He said the county wants all pending legal matters to be resolved, and is preparing to implement the law if it survives the legal challenge.

Maui voters approved the measure earlier this month, and it was set to take effect after officials certified the election results.
